Mike Tyson did the right thing. The dude that got in trouble should have respected his calls to shut the fuck up.
Also, the argument about consciousness of drunk is not valid because even in Russian law being drunk and commiting a crime is aggravating reason. Getting so drunk as to not be able to control your actions is not an excuse, it is a public hazard. You absolutely know what you are doing when you consider getting drunk - you can evaluate the possible consequences while you are still sober. So can he learn his lesson? Absolutely yes - he should drink less.
